Acceptance of Terms

By accessing or using OpenShortPath Cloud, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

Description of Service

OpenShortPath Cloud is a URL shortening service that allows users to create shortened links. The service is provided "as is" and "as available" without any warranties or guarantees.

No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of the service
• Uninterrupted or error-free operation

We do not guarantee that the service will be available at all times, that it will be free from errors, or that it will meet your specific requirements.

Prohibited Uses

You agree not to use OpenShortPath Cloud for any unlawful or prohibited purpose. Specifically, you must not:

Abuse and Misuse

• Spam or Phishing: Create links that are used for spam, phishing, or other fraudulent activities
• Malware or Harmful Content: Distribute malware, viruses, or other harmful code through shortened links
• Illegal Activities: Use the service for any illegal purpose or to facilitate illegal activities
• Copyright Infringement: Create links to content that infringes on intellectual property rights

System Abuse

• Rate Limit Violations: Attempt to circumvent rate limits or abuse the API
• Automated Abuse: Use automated tools to create excessive links or overwhelm the system
• Circumvention: Attempt to bypass security measures, authentication, or access controls
• Reverse Engineering: Attempt to reverse engineer, decompile, or disassemble any part of the service

Content Restrictions

• Harmful Content: Create links to content that is defamatory, harassing, threatening, or otherwise harmful
• Adult Content: Create links to adult content without appropriate warnings or in violation of applicable laws
• Violence or Hate Speech: Create links to content promoting violence, hate speech, or discrimination

Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring that your use of the service complies with these Terms
• Any content you create or links you generate

Service Availability

We reserve the right to:

• Modify or discontinue the service at any time without notice
• Limit or restrict access to the service for any reason
• Remove or disable links that violate these Terms
• Suspend or terminate accounts that violate these Terms

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENSHORTPATH CLOUD AND ITS OPERATORS SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or downtime
• Links that become broken or unavailable
• Any damages resulting from your use or inability to use the service

Indemnification

You agree to indemnify and hold harmless OpenShortPath Cloud, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you create or links you generate

Termination

We may terminate or suspend your access to the service immediately, without prior notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Suspected abuse or misuse of the service
• Legal or regulatory requirements
• At our sole discretion

Upon termination, your right to use the service will cease immediately, and we may delete your account and associated data.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by:

• Updating the "Last updated" date
• Providing notice through the service or via email (for registered users)

Your continued use of the service after changes are posted constitutes acceptance of the modified Terms.

Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law provisions.

Any legal disputes, claims, or proceedings arising out of or relating to these Terms of Service or your use of OpenShortPath Cloud shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada.
